Sale Terms and Conditions

- Unless waived by announcement, there shall be a $1,000 starting bid on weanlings, $1,300 on yearlings and $1,600 on two-year-olds offered.
- Read the Terms and Conditions of the Sale Carefully.
Buyers are bound by them whether you read them or not.
- $25.00 will be added to the purchase price of every horse. This constitutes one-half of the entry fee for the 2009 Lyons Den Futurity.
- All buyers must register prior to the sale. Sales office will be open for registration Saturday, November 7, 2009 at 9:00 a.m. A valid driver’s license or other form of positive picture identification will be required.
- In the event of a dispute between two or more bidders, the horse in dispute shall immediately be put up again for advance bids. If there are no advance bids, the horse shall go to the person from whom the auctioneer recognizes as the last bid.
- There will be a $50 charge on ALL returned checks, regardless of reason.
- Immediately after the horse is sold, it will become the risk and responsibility of the buyer, but possession of the horse cannot be obtained until payment is made in full.
- All horses must be moved by 6:00 pm Saturday, November 7, 2009 following the sale. Failure to remove the horse will obligate the buyer to pay all costs associated with board, transportation and security of the horse.
- Lyons Den Farms and V-Cross Ranch reserve the right to distribute and/or publish the results of this sale in publications or post the results on its website.
- Upon failure of compliance with any of these conditions, the lot shall be resolved by private or public sale and the deficiency (if any) shall be made good by the defaulter immediately.
- Every effort has been made to assure the correctness of the catalog, however errors may occur. Lyons Den Farms, V-Cross Ranch, the auctioneer, and the catalog printer are not responsible for errors and omissions, and assumes no liability on its part or on the part of the seller as to any statement, either verbal or written, regarding any horses sold. Please notify us if you see any errors.
- BUYERS ARE CAUTIONED TO PAY CLOSE ATTENTION TO THE ANNOUNCER AND AUCTIONEER’S ANNOUNCEMENTS.
- Buyer has the right to a veterinary examination before the horse is removed from the sale premises. Once the horse has been removed from the sale premise there is no recourse.
- Status of pregnant mares to be sold based on manual and/or ultrasound veterinary examination will be announced at the time of dale. Purchaser may have any broodmare examined by a veterinarian acceptable to the seller before the mare is removed from the sale premises. If the broodmare is found to be certified, the purchaser shall pay the examination fee. If not certified, the Seller shall pay said fee, otherwise there is no guarantee.
- All horses in this sale will have a 30-day Health Certificate and be tested negative for Equine Infectious Anemia (Coggins Test) within six months of sale date.
- Horses are offered for sale according to the laws of the State of Louisiana.
- Examine Horses Carefully Prior to Purchasing.
- Leave hip numbers on all horses, leave horses in their original stalls.
- All accounts must be paid immediately following the sale.
- All payments must be made in U.S. currency on U.S. Banks only.
- Method of payment shall be Cash, Cashier’s Check, or Personal Check with proper Identification. All personal or company checks must be accompanied by a Bank Letter of Guarantee NO EXCEPTIONS.
- NO BANK DRAFTS ACCEPTED!
- Announcements made from the auction stand will take precedence over any printed material
- After making the final bid on a horse, you will be asked to complete and sign the Purchase Agreement. Be sure to confirm the correct hip # and price before you sign. Please print your name and address clearly.
- There is no implied warranty made by the auctioneer, announcer or Lyons Den Farms / V-Cross Ranch as to the merchantability or fitness for a particular purpose for any animal offered for sale in this auction.
- All responsibility lies between the consignor and the buyer.
- Buyers paying for the horses with a personal or company check will have there registration papers held for a period of 15 working days in order to allow their checks to clear the bank. Buyer’s paying with cash or cashier’s check will receive their registration papers on the sale day.
- A paid receipt will be required to remove the horses from the sales ground.
- All sales made on sale day must be made through the sale office.
- EVERYONE ATTENDING THE SALE AGGREES TO HOLD LYONS DEN FARMS/V-CROSS RANCH, SELLERS, BUYERS AND THE SALE FACILITIES HARMLESS FROM ANY PERSONAL INJURY, DEATH, THEFT OR VANDALISM.
- The seller is responsible to announce any known defects in their horses. What is a defect to one may not be a defect to others.
Incentive for LaSH Participants:
Lyons Den Farms will award $500 to any Lyons Den bred horse competing in the LaSH 2009 Competition and receiving the honor of High
Point horse in each division (open, cowboy, novice, or youth) and $250 to any Lyons Den bred horse competing in the LaSH 2009
Competition and receiving the Reserve High Point award in each division (open, cowboy, novice, or youth).
